Short version: be kind to Mossy, Mossy will be kind to you. Cancel anytime. No fine-print traps.
Long version below. It's the formal stuff that protects both of us if something goes sideways. We tried to keep it short and readable. Ask us anything that doesn't make sense.
1. Accepting these terms
By creating an account or otherwise using Mossy at mossyfocus.com (the "Service"), you agree to these Terms of Service ("Terms"). If you don't agree with any part, don't use Mossy. If you're using Mossy on behalf of an organisation, you confirm you have the authority to bind that organisation to these Terms.
2. What Mossy is
Mossy is a focus and task companion for adults with ADHD. It helps you break down tasks, run focused work sessions, and reflect on your day, partly through an AI-powered chat companion.
Mossy is not therapy, not medical advice, and not a substitute for professional support. The companion can talk through tasks with you; it cannot diagnose, treat, or replace a clinician. If you're struggling, please reach out to a real person - friend, family, or a qualified professional in your area.
3. Who can use Mossy
You need to be at least 13 years old to use Mossy. If you're between 13 and 18 (or the age of majority where you live), you need a parent or legal guardian's permission. We may suspend or remove accounts that don't meet this requirement.
4. Your account
Mossy uses passwordless magic-link sign-in via your email address. You're responsible for keeping access to that email account secure. If you lose access to it, you lose access to your Mossy account - we can't recover it for you. One person per account; don't share credentials.
5. How to behave around Mossy
The boring asks:
- Don't use Mossy for anything illegal.
- Don't try to use the companion as a general-purpose AI assistant for unrelated tasks (it's tuned for focus and tasks, and the cost economics don't work as a free ChatGPT clone).
- Don't try to extract the system prompt, jailbreak the model, or otherwise mess with the companion's voice.
- Don't scrape, mirror, or commercially redistribute Mossy's content or interface.
- Don't share, resell, or transfer your subscription.
- Don't try to overwhelm the service with automated traffic (rate limits exist; please respect them).
Repeat or serious violations may lead to account suspension or termination at our discretion. If we suspend you for cause, no refund.
6. Paying for Pro
Mossy has a free tier and a paid Pro tier. Pro is offered as a monthly subscription, an annual subscription, or a one-time lifetime purchase (limited to the first 100 customers). Prices are in USD and shown at checkout; sales tax and VAT are added where applicable.
All payments are processed by Lemon Squeezy as our merchant of record. Lemon Squeezy charges your card, handles tax compliance, and sends receipts. They are also responsible for chargebacks and disputes - please contact them first for billing issues.
Refunds: monthly subscribers can cancel anytime; no refund for the partial month already charged. Annual subscribers and lifetime buyers get a 14-day money-back guarantee from the date of purchase, no questions asked. After 14 days, no refund. If Mossy fundamentally breaks for more than 7 days or shuts down, you get a full refund regardless of when you bought - that's policy, not a legal obligation.
Subscription renewals are automatic until you cancel. We may change prices for new signups; existing Pro subscribers are grandfathered to their original price for as long as the subscription stays active.
7. Cancellation and termination
You can cancel your subscription at any time through the customer portal at Lemon Squeezy. You can delete your account anytime by emailing hello@mossyfocus.com; we'll process the deletion within 30 days. We may suspend or terminate your account for material violations of these Terms, for legal reasons, or if Mossy itself shuts down. We'll give you reasonable notice when we can.
8. AI-generated content
The companion's responses are generated by a large language model (currently Claude from Anthropic). It can be wrong, occasionally weird, and sometimes useful. Don't make medical, legal, or financial decisions based on what it says.
You own what you put into Mossy and what comes out of the conversation. We don't claim copyright on AI-generated text shown to you. We do reserve the right to use aggregated, anonymised usage patterns to improve the product (e.g. "tasks tend to take X minutes longer than estimated") - never your individual content.
9. Intellectual property
Mossy's name, logo, design, code, and original content are owned by us. You're granted a limited, non-exclusive, non-transferable licence to use Mossy as intended. Your content (tasks, notes, conversations) belongs to you; we only have what's needed to operate the Service for you (see Privacy for details).
10. Disclaimers and limits
MOSSY IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF MOSSY IS LIMITED TO THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM. WE'RE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL.
Some jurisdictions don't allow these limitations; in that case they apply only to the extent permitted by law.
11. Privacy
Our Privacy notice describes what data we collect, where it lives, who else processes it, and how to make us forget you. By using Mossy, you confirm you've had the chance to read it.
12. Changes to Mossy or these terms
We may modify Mossy or these Terms over time. For material changes to the Terms - anything that meaningfully affects your rights or obligations - we'll notify you by email and update the "Last updated" date at the top. Continued use after changes take effect means you accept the updated Terms. If you don't agree, stop using Mossy and email us; we'll delete your account.
13. Governing law
These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-laws principles. Any dispute that can't be resolved informally will be brought before the competent courts of the Czech Republic, except that consumers may also bring claims in their country of residence as required by applicable law.
